ARTICLE 1 – SCOPE OF APPLICATION

These General Conditions of Sale apply, without restriction or reservation, to all sales concluded by the company IMSC DILECTA. (“The Seller”) from non-professional buyers (“The Customers or the Customer”), wishing to acquire the products offered for sale by the Seller (“The Products”) on the website www.dilectacycles.com here- hereinafter referred to as “the Website”.
These General Terms and Conditions of Sale specify in particular the conditions of ordering, payment, delivery and management of any returns of Products ordered by Customers.
The main characteristics of the Products and in particular the specifications, illustrations and indications of the dimensions or capacity of the Products, are presented on the Website. The Customer is required to read these carefully before ordering. The choice and purchase of a service is the sole responsibility of the Customer. The photographs and graphics presented on the Website are not contractual and cannot engage the responsibility of the Seller.
The Customer is required to refer to the description of each Product in order to know its properties and essential features. Product offers are subject to the limit of available stocks, as specified when placing the order.

These General Terms and Conditions of Sale apply to the exclusion of all other terms, including those applicable to sales in shops or through other distribution and marketing channels.
These General Terms and Conditions of Sale are accessible at any time on the Website and will prevail, if necessary, over any other version or any other contradictory document. The Customer declares that he has read the present General Terms and Conditions of Sale carefully and has accepted them by checking the box provided for this purpose before the implementation of the on-line ordering procedure.
These General Terms and Conditions of Sale may be subject to subsequent changes, the version applicable to the Customer’s purchase is the one in force on the Website on the date the order is placed. In the absence of proof to the contrary, the data recorded in the Seller’s computer system shall constitute proof of all transactions concluded with the Customer.
The Customer acknowledges having the capacity required to contract and acquire the Products offered on the Website.
The Products presented on the Website are offered for sale for the following territories:
Europe and the entire world. The modifications of these General Terms and Conditions of Sale are opposable to the users of the Website from the moment they are published on-line.

ARTICLE 2 – ORDERS

The Customer must select the Products they wish to order on the Website as follows:
1 / Choice of articles and their addition to the basket.
2 / Validation of the contents of the basket.
3 / Account creation form or if the customer already has an account, identification of the customer using his or her personal identifiers.
4 / Choice of delivery method and place of delivery. The Customer is informed of the cost of the shipment.
5 / Verification of the order, selection of the payment method, acceptance of the General Terms and Conditions of Sale.
6 / On-line payment.
7 – Payment validation
To place an order, the Customer must follow the ordering procedure as described on the Website when ordering.
The Customer must check the completeness and the conformity of the information provided during the order, in particular concerning the delivery address and the billing address.
The Seller cannot be held responsible for any data entry errors and the consequences thereof, so that the costs incurred for the reshipment of the order would, in this case, be borne by the Customer.
The Customer confirms his order through the electronic purchase procedure on the Website. This customer confirmation materializes the sales contract between the Customer and the Seller. The sale will not be firm and final and the availability and shipping times do not begin until the Customer has sent the confirmation of acceptance of the order by email to IMSC DILECTA. The sale will only be considered final after sending to the Buyer confirmation of the acceptance of the order by the Seller by email and after receipt by the latter of the full price of the order. The Seller reserves the right to cancel or refuse any Order from a Customer with whom there is an existing dispute in relation to the payment of a previous order.
In the event of payment of the order by means of the 3x 4x Oney system under the conditions of article 4, confirmation of the order by IMSC DILECTA cannot take place before the expiry of a period of 14 calendar days, which corresponds to the right of withdrawal enjoyed by the customer to renounce the credit. In the event of a waiver of the credit, the sale for which the Customer requested the credit request is resolved, unless the Customer decides to pay cash.
The Customer will be able to follow the progress of his order on the Site, section “My Account”.

ARTICLE 3 – PRICES

Prices are shown in euros. They do not take into account the delivery costs, invoiced in supplement, and indicated before the validation of the order. Prices take into account VAT applicable on the day of the order and any change in the applicable VAT rate will automatically be reflected in the price of products in the online store. The payment of the totality of the price must be realized at the time of the order. At no time can the sums paid be considered as a deposit or advance payment.
In the context of an export sale, the taxes in force in the buyer’s country remain the responsibility of the latter.
The product selling prices can be modified by IMSC DILECTA. any time.

ARTICLE 4 – Conditions de paiement

Payment by Bank Card

In order to guarantee the security of your on-line payments, IMSC DILECTA uses the secure virtual TPE system, which is a device prepared to make secure payments in the internet sales system.
The virtual TPE uses SSL encryption in all communications made with our merchant site, the data is thus protected from any disclosure to a third party in order to ensure the confidential nature of the transaction.
Additional mechanisms are provided to ensure the authenticity and origin of transactions and thus avoid any manipulation of data by third parties.
The card data is not known to the retailer, which prevents this information from being used subsequently by third parties fraudulently. This information remains conveniently stored by the Virtual TPE which, in turn, will provide it to the payment system when necessary.
Consequently, all transactions carried out through the Virtual TPE will enjoy all the guarantees of security, confidentiality and integrity for the parties participating in it, i.e. both for the card holder and his issuing institution, as for the trade and its acquiring establishment.
In order to provide maximum security, you may be asked for any order exceeding an amount of € 99, an OTP (one-time payment) security code provided by your bank to verify that you are the holder of the card used to make the payment. If you do not have or receive this code, please contact your bank in order to complete the operation.

Payment via PayPal

PayPal is a secure payment method that allows you to quickly pay for your items without sharing your bank details with vendor sites.
However, PayPal will request them when you create your account. They are then permanently encrypted and secure. If you already have a PayPal account, you can use it on our site to pay for your purchases quickly and securely. If you don’t have a PayPal account, you can still choose this payment method. When paying, you will be directed to a PayPal page where you enter your bank details and choose whether or not to create a PayPal account.

Bank transfer payment

After finalizing your order, you will receive instructions on how to proceed with the bank transfer.

ARTICLE 5 – DELIVERY

The products are delivered to the address indicated by the consumer on the order form throughout Europe and the world.
Any anomaly concerning the delivery (damage, missing product compared to the delivery slip, damaged package, broken products, etc…) must be indicated on the delivery note in the form of “handwritten and precise details and reservations”, accompanied by the customer’s signature.
The client must also simultaneously confirm any irregularities to the transporter within (2) two working days following delivery by means of a registered letter detailing said claims sent with a proof of delivery receipt.
The consumer must send a copy of this letter by regular mail to IMSC DILECTA.
The buyer is required to check the condition of the package and the number of packages delivered in the presence of the delivery person. In case of doubt, the customer is required to refuse the package and report these incidents to IMSC DILECTA.
All our shipments are covered by insurance corresponding to the value of the package and paid for by our company.
Delivery times are generally 48 to 72 hours for France, and depending on the time indicated by the carrier, for the rest of the world. The delivery deadlines are given for reference only. Any possible delays may not give rise to damages, withholding or cancellation of the order by the buyer.
In the event of a delivery error, the Customer shall submit to IMSC DILECTA on the day of delivery or, at the latest, on the first business day following the date of delivery, any claim of error in delivery and/or non-conformity of the products in kind or in quality with the indications on the order form. Any complaint formulated beyond this time delay will be rejected.

ARTICLE 6 – SHIPPING COSTS

Shipping costs will be indicated and added to the total amount of the order every time a buyer makes an order. The total shipping costs will be adjusted according to the order’s destination

ARTICLE 7 – TRANSFER OF OWNERSHIP – TRANSFER OF RISKS

The transfer of ownership of the Seller’s products to the Customer will be made only after full payment by the latter, and regardless of the date of delivery of those products.
Regardless of the date of transfer of ownership of the Products, the transfer of the risks of loss and deterioration relating thereto shall only take place when the Customer takes physical possession of the Products. The Products therefore leave our premises at the risk and peril of the Seller.

ARTICLE 8: PRODUCT AVAILABILITY

In case of unavailability of the ordered product, in particular because of our suppliers, the consumer will be informed as soon as possible and will have the possibility either to cancel his or her order or to change it. If an order is canceled, we commit ourselves to refund you as soon as possible, or to transform it into a purchase voucher.

ARTICLE 9 – RIGHT OF WITHDRAWAL

The Customer has a period of 14 (fourteen) days from receipt of the Product selected by him/her when placing the order to exercise his/her right of withdrawal from the Seller, without having to justify his/her reasons or pay any penalty, for the purpose of exchange or reimbursement, provided that the Products are returned in new condition, in their original packaging, and in perfect condition, and within 14 (fourteen) days following the notification to the Seller of the Customer’s withdrawal decision.
Returns that do not meet these criteria will not be refunded and will remain at the disposal of the consumer at our premises.
The shipping costs remain the responsibility of the customer. Returns with “postage paid by recipient” or “cash on delivery” will be refused.

All products that do not fall within the scope of this commercial guarantee will nevertheless benefit from the full legal guarantees in force.

ARTICLE 11 – DATA PROCESSING AND FREEDOM

The personal data requested from the Customer are necessary for the processing of his/her order and in particular, to create invoices. These data may be communicated to any partners of the Seller responsible for the execution, processing, management and payment of the orders. ARTICLE 12 – PARTIAL INVALIDATION

If one or more provisions of these General Terms and Conditions of Sale are held to be invalid or declared to be such under any law or regulation, or after a final ruling by a competent court, the remaining provisions will maintain their full force and scope.

ARTICLE 13: NON-WAIVER

The failure of either Party to claim a breach by the other Party for any of these obligations shall not be construed in the future as a waiver of the obligation in question.

ARTICLE 14 – APPLICABLE LAW

These General Terms and Conditions of Sale are subject to Andorran law. This law applies in both form and substance. In the event of a dispute or complaint, the consumer will first contact COMESPORT SA to obtain an amicable solution.
